Common Questions
Criminal Defense FAQ
What should I do if I am arrested in Sacramento?
Exercise your right to remain silent under the Fifth Amendment and request an attorney immediately. Do not answer questions, consent to searches, or sign any documents without your lawyer present. You have the right to make a phone call within three hours of your arrest under California Penal Code Section 851.5.
How long does a criminal case take in Sacramento Superior Court?
Misdemeanor cases typically resolve within 30 to 90 days. Felony cases usually take 6 to 12 months or longer, depending on the complexity of the charges, the amount of evidence, and whether the case goes to trial. Under Penal Code Section 1382, you have the right to a speedy trial within 30 days for misdemeanors and 60 days for felonies.
Can criminal charges be expunged in California?
Yes. Under California Penal Code Section 1203.4, if you successfully completed probation, you may petition to have your conviction dismissed (expunged). Proposition 47 also allows certain felonies to be reclassified as misdemeanors. Our attorneys can evaluate your eligibility and file the appropriate petitions.
What is the difference between a misdemeanor and a felony?
Misdemeanors carry a maximum sentence of one year in county jail and fines up to $1,000. Felonies carry sentences of 16 months or more in state prison and fines up to $10,000 or more. Some offenses are "wobblers" that can be charged as either, and our attorneys work to ensure the lowest possible classification.
